TERMS AND CONDITIONS OF "MD ESTATE" LTD. FOR INTERMEDIARY ACTIVITIES

 


1. General Provisions

1.1. These Terms and Conditions govern the relationship between "MD Estate" Ltd., with registered office and management address at Sofia 1734, Malinova Dolina, Yordan Stratiev Str. 1A (hereinafter referred to as the "Agency") and clients – natural and legal persons using its services.
1.2. By using the services provided by the Agency, the client confirms that they are familiar with these Terms and Conditions and agrees to comply with them.


2. Services Provided by the Agency

2.1. The Agency provides intermediary services in the field of real estate, including:

  • buying and selling real estate;

  • renting and leasing real estate;

  • consulting and assistance in investment transactions with real estate.

2.2. The Agency also provides legal assistance in the preparation of the necessary documents for the transactions.
2.3. Advertising and marketing services related to the presentation and promotion of properties.


3. Rights and Obligations of the Parties

3.1. The Agency undertakes to:

  • provide accurate and up-to-date information about the available properties;

  • assist in organizing property viewings and negotiations;

  • maintain confidentiality regarding information provided by clients;

  • provide assistance in closing deals, including preparing the necessary documents.

3.2. The Client undertakes to:

  • provide truthful and complete information about the property or property search;

  • not engage in direct negotiations with third parties referred by the Agency without prior notification;

  • pay the agreed commission to the Agency upon the successful completion of a transaction.


4. Commission Fee

4.1. For renting or leasing a property: The commission fee is due upon the successful completion of the lease agreement.
4.2. For buying and selling a property: The commission fee becomes payable upon the signing of a Preliminary Contract or by additional agreement between the parties, as described in the individual agreement between them.
4.3. The amount of the commission fee is determined in the individual agreement between the parties.


5. Contractual Relations and Termination

5.1. The relationship between the Agency and the client is governed by a written intermediary agreement, which must be signed before the commencement of the relevant activities.
5.2. The agreement may be for a fixed term or indefinite.
5.3. Any agreement may be terminated by mutual consent of the parties or by written notice from one party with prior notice, unless otherwise agreed in the contract.


6. Liability

6.1. The Agency is not liable for actions or omissions by third parties (such as property owners, buyers, tenants, etc.), nor for inaccuracies in the information provided by them.
6.2. The Agency is not liable for consequences arising from unlawful actions by clients or third parties related to the transactions.
6.3. Disputes arising will be settled through negotiations between the parties, and if no agreement is reached, by judicial means in accordance with Bulgarian legislation.


7. Final Provisions

7.1. These Terms and Conditions may be amended and supplemented by "MD ESTATE" Ltd., and any changes will take effect from the date of publication.
7.2. For any issues not regulated herein, the provisions of the current legislation of the Republic of Bulgaria shall apply.
